Dear Sir,
I am writing in response to the letters written by Ronald G. Hudson and Paul Thain, published in the February 13-19 issue of the Guadalajara Reporter. I certainly support part of Mr. Hudson’s suggestion that the Reporter publish a picture of Janet Peace. She is a real heroine. She has had the courage to question the policies and practices of the “establishment” – the Chula Vista Board of Directors headed by Gary Bradley.At great personal cost to herself and her family, Janet has lead the fight to protect Chula Vista homeowners. She is neither mean-spirited nor self-indulgent as he claims. Her goal from the beginning of her involvement with the homeowners’ association has been to give voice to homeowners and protect the homeowners’ rights and property values.
Mr. Thain says he’s embarrassed by Janet Peace. I’m in awe of her strength and dedication. He says her group “started a coup for they own selfishness and over-rode the democratic process …” On the contrary, Janet and her group have been very concerned about the erosion of democratic rights in the Chula Vista homeowners’ association. Some examples of the erosion of those rights can be seen in the lack of homeowner access to Board meetings and the lack of published Minutes of Board meetings during 2008 and 2009. Another example of imperiled homeowner rights is the improper revision of the Association’s bylaws in 2008. The 2008 revision severely reduced the power and potential property values of the homeowners by giving unmonitored powers of bylaw revision to the Board of Directors. Many homeowners were concerned by these bylaw revisions. The Chula Vista Association’s bylaws allow a special assembly to be called if requested by at least 20 homeowners. In 2009 more than 50 homeowners requested a special assembly to address the 2008 bylaw revisions. After the Bradley Board of Directors denied the request, the homeowners began working to call a special assembly as is anyone’s right under Jalisco civil code.
Janet Peace and another community member, Roy Schwartzenburg, were elected to the board of directors in January of 2009 by a large majority of homeowners. Yet they were suspended from the Board on the basis of bogus charges which were merely stated but never substantiated. Their suspension came on the heels of their support for the homeowners’ special assembly.
Many documents, emails, claims and counter-claims have flooded the Chula Vista neighborhood in the last few months. I invite Mr. Hudson and Mr. Thain to go to www.chulavistahomeowners.com to review the information and supporting documentation provided. They will then have a more complete understanding of the issues in Chula Vista.
